Part A โ€“ General Website Terms of Use

1. About Us and Acceptance of These Terms

1.1 This website www.seasoncars.com (the โ€œWebsiteโ€) is operated by Season Car Rental Limited, a company registered in England and Wales under company number 11934150, whose registered office is at Arch 56, Ingate Place, Battersea, London SW8 3AG (โ€œSeason Carsโ€, โ€œweโ€, โ€œusโ€ or โ€œourโ€).

1.2 By browsing the Website, submitting an enquiry, requesting a quote, or making a booking, you (โ€œyouโ€ or โ€œthe Hirerโ€) agree to be bound by these Terms of Use and, where you proceed to hire a vehicle, the Hire Terms set out in Part B. If you do not agree to these terms, please do not use the Website or make a booking.

1.3 These terms should be read together with our Privacy Policy, Data Protection Policy and Marketing Policy, all available on the Website, which explain how we collect, use and protect your personal data.

2. Use of the Website

2.1 You may use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Website by, any other person.

2.2 You must not: (a) attempt to gain unauthorised access to the Website, the server on which it is hosted, or any server, computer or database connected to it; (b) attack the Website via a denial-of-service attack; (c) use any automated system, including “robots” or “spiders”, to access the Website for any purpose without our express written permission; or (d) submit false, misleading or fraudulent information through any enquiry, quote or booking form.

2.3 We do not guarantee that the Website, or any content on it, will always be available, uninterrupted, or free from errors, viruses or omissions. We may suspend, withdraw or restrict access to all or part of the Website for business or operational reasons at any time.

3. Vehicle Listings, Pricing and Quotations

3.1 All prices displayed on the Website are indicative and inclusive of UK VAT at the applicable rate and of our standard insurance cover with excess (see Part B, clause 17). Prices exclude the refundable security deposit, any optional extras, excess waiver, congestion charges, tolls, fuel, fines, and any additional charges described in these terms.

3.2 We take reasonable care to ensure that vehicle images, specifications and prices shown on the Website are accurate at the time of publication. However, vehicle availability, specification and colour are subject to change, and the vehicle supplied may vary from the image shown; where this occurs we will supply a vehicle of equivalent or higher category and will notify you in advance where reasonably possible.

3.3 A quotation is not a confirmed booking. A booking is only confirmed once we have issued a written booking confirmation and received the applicable deposit or payment in accordance with Part B, clause 13.

4. Intellectual Property

4.1 The Website and its entire content, features and functionality (including all text, images, logos, graphics and software) are owned by Season Cars, our licensors or other providers of such material, and are protected by UK and international copyright, trademark and other intellectual property laws.

4.2 You may view, download and print material from the Website for your own personal, non-commercial use only, provided you do not modify the material or remove any copyright or proprietary notice. Any other use requires our prior written consent.

5. Third-Party Links

5.1 The Website may contain links to third-party websites (including payment providers and social media platforms). We have no control over, and accept no responsibility for, the content, accuracy or availability of any linked third-party website.

6. Liability

6.1 Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.

6.2 Subject to clause 6.1, we accept no liability for any loss or damage arising from your use of, or inability to use, the Website, or from any reliance placed on any content of the Website, whether such content is provided by us or a third party.

6.3 Liability arising from an actual vehicle hire is governed exclusively by Part B of these terms and the rental agreement signed at the point of collection or delivery, not by this Part A.

7. Governing Law and Jurisdiction

7.1 These Terms of Use and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction, save that if you are a consumer resident elsewhere in the UK you may also be able to bring proceedings in your home jurisdiction.

8. Changes to These Terms

8.1 We may revise these Terms of Use at any time by amending this page. Please check this page periodically to take notice of any changes, as they are binding on you. The Hire Terms in force at the date your booking is confirmed will apply to that booking.

Part B โ€“ Vehicle Hire Terms and Conditions

These Hire Terms apply to every booking made with Season Cars, whether made via the Website, by telephone, by email, or through a Sales Representative, and form part of the rental agreement you will be asked to sign at the point of collection or delivery of the vehicle. In the event of any conflict between these Hire Terms and the signed rental agreement, the signed rental agreement shall prevail in respect of that specific hire.

9. Pricing

9.1 All our prices are inclusive of VAT and of our standard insurance cover with excess. Prices exclude the refundable security deposit, fuel, congestion and toll charges, fines, excess mileage, valeting, and any optional extras, unless stated otherwise on your quotation.

10. Drivers

10.1 All drivers hiring a supercar or premium luxury vehicle must be aged 30 to 70 (inclusive) with a minimum of 5 years’ driving experience. Your Sales Representative will confirm which vehicles in our fleet this requirement applies to.
10.2 All other vehicles may be hired by drivers aged 25 to 70 (inclusive) with a minimum of 3 years’ driving experience.

10.3 Before collection, every driver must provide: (a) a full, valid driving licence; (b) a DVLA Check Code (UK licence holders); (c) a valid passport; (d) one proof of address dated within the last 3 months (a utility bill or bank statement, which must match the billing address of the payment card used – mobile phone bills are not accepted); and (e) a credit card in the name of the main driver for the security deposit. Supercar hires require a credit card for the deposit; no other card type is accepted for that purpose.
10.4 Foreign (non-UK) licence holders must, in addition to the above, comply with clause 12 (International Licences) and provide any further identification we or our insurers reasonably require, which may include an International Driving Permit where their home licence does not meet UK recognition requirements.

10.5 All identification and supporting documents must be received by us at least 7 days before the hire date to allow sufficient time for processing.
10.6 If you have less than 7 days until your hire date, please send your documents as soon as possible and discuss this with your Sales Representative.
10.7 Documents submitted after the agreed deadline may cause delays to your booking, up to and including cancellation of the booking.
10.8 Season Cars is not responsible for any cancellation of, or delay to, a booking caused by late submission of documents, and the full booking rate and/or cancellation fee (clause 20) will remain payable.

11. UK Licence Requirements

To be eligible to hire with us, UK licence holders must:

– Have held a full UK driving licence for at least 3 years.
– Not have more than 1 minor motoring conviction within the last 3 years (from the date of conviction) of any of the following codes: CU (except CU80) / LC / MW / PC / PL / SP / TS / MS (except MS50).
– Not have any conviction within the last 4 years (from the date of conviction) of any of the following major motoring offence codes: AC / BA / CD / CU80 / IN / MR / MS50 / DR / XX / TT / UT / DD / DG.
– Have no pending prosecutions or police enquiries.
– Have had no accident, incident, fire or theft loss in the last 3 years.
– Have no criminal convictions, other than convictions that are no longer disclosable under the Rehabilitation of Offenders Act 1974, as amended by the Legal Aid, Sentencing and Punishment of Offenders Act 2012.

11.1 These requirements are set by our insurers. Where a booking is declined solely because a driver does not meet these insurance requirements, we will refund the full amount you have paid, less any card-processing or bank-transfer fees we have actually incurred.

12. International Licences

12.1 All bookings involving an international (non-UK) licence holder are subject to referral to, and approval by, our insurers.
12.2 International licence documents must be submitted no later than 7 days before the booking start date. Documents submitted after this point may delay the start of your hire, up to and including cancellation.
12.3 Season Cars is not responsible for delays or cancellations caused by late submission of international licence documents, and the full booking amount remains payable.
12.4 All bookings involving an international licence are subject to an additional £2,000 excess.

13. Payments

13.1 All payments must be made using the main driver’s own credit or debit card, unless we have agreed a bank transfer or corporate credit account in advance.
13.2 Payment may alternatively be made by bank transfer. Where paying by bank transfer, cleared funds must reach our account before the vehicle leaves our premises or is delivered to you.
13.3 All outstanding amounts must be paid in full before the vehicle leaves our premises or is delivered, unless you hold a corporate account with agreed credit terms with us. We do not offer credit to any customer who does not hold such an agreed account.

Accepted payment methods: Mastercard, Visa Credit, American Express, Debit Cards, and Bank Transfer.

14. Payment via Pay-by-Link

14.1 Where you pay via a Pay-by-Link payment request, the initial payment amount is deducted upon you providing your card details; your full card details are not held by Season Cars.
14.2 We may use third-party providers for elements of the payment process, including payment processing. Those third parties may require you to accept their own terms and conditions, which will comply with UK law on privacy and data retention.
14.3 The legal entity you are paying is Season Car Rental Limited, company number 11934150, registered office Arch 56, Ingate Place, Battersea, London SW8 3AG. Only the law of England and Wales applies to payments made to Season Car Rental Limited.
14.4 The cancellation and refund policy applicable to all bookings, including those paid via Pay-by-Link, is set out in clause 20 (Cancellations) below.

15. Security Deposit

15.1 The security deposit is a pre-authorisation on the main driver’s credit card, processed on the day of collection or delivery.
15.2 Security deposits must be taken by chip-and-PIN transaction, either at our office at the time of collection, or on delivery.
15.3 As this is a pre-authorisation, the funds are held rather than debited from your account. Your available balance will reduce while the hold is in place, and will be restored once the hold is released.

15.4 The security deposit is released within 7 working days of the vehicle being checked in and approved by our aftercare team. Once released, it can take up to a further 10 working days to appear in your account, depending on your card issuer.
15.5 You may request an early release of your deposit for a fee of £10, which will release the deposit within 3 working days of us confirming (by email from our Aftercare Team) that the vehicle has been returned to an acceptable standard.
15.6 A security deposit is required for every booking; the vehicle will not be released without it. If you are unable to provide the full security deposit, any monies already paid are non-refundable, and if this occurs less than 48 hours before the hire is due to start, 100% of the booking amount becomes payable regardless of any prior agreement.

Accepted cards for security deposits (standard vehicles): Mastercard, Visa Credit, American Express.
Accepted cards for security deposits (supercars): Credit cards only.

16. Booking Collection and Return Times

16.1 Where a booking begins on a Monday, the earliest collection time is 3:00pm, so as not to interfere with weekend bookings.
16.2 Where a vehicle is due to be returned on a Friday, it must be returned by 12:00 noon at the latest, so as not to interfere with weekend bookings.
16.3 These timing requirements may be waived by a Sales Representative on request; however, an early collection or late return fee of £50 may apply.
16.4 Your Sales Representative will notify you in advance of any charge arising from your requested collection or return time.

17. Insurance

17.1 Where you select our insurance option at the time of booking, we provide UK fully comprehensive insurance, provided every driver meets the eligibility requirements set out in clauses 10–12.
17.2 Our insurance includes a damage excess and a total-loss/write-off excess, which represents your maximum liability for damage to the vehicle or in the event of an accident. The applicable excess depends on the vehicle hired and is stated on your quotation.

18. Additional Costs and Aftercare

18.1 At collection, you will be asked to sign a rental agreement and an Aftercare Sheet; a copy of both is available in advance on request.
18.2 On return, the vehicle is checked in by our staff and you will receive an email confirming whether it meets our required standard. Any additional charge for damage, fuel, or excess mileage will be set out in that email.
18.3 Where a vehicle is returned excessively dirty, or conditions (e.g. weather) prevent a full inspection at the time of return, we will carry out a secondary inspection once the vehicle has been valeted. Your Sales Representative will tell you if this applies to your hire.
18.4 Damage to tyres, alloys or rims will be repaired after the booking ends, at the renter’s full cost.

19. Airport and Delivery Service

19.1 Where you select airport delivery, a complimentary meet-and-greet service is included. Our driver will meet you inside the terminal holding a name card, and escort you to your vehicle, which will be parked in the short-stay car park.

20. Cancellations

This clause sets out the single cancellation and refund policy that applies to every booking, however paid (card, bank transfer or Pay-by-Link).

20.1 If you cancel within 14 calendar days of your booking confirmation (the date your booking deposit was paid), and your hire is not due to start within 14 calendar days of that confirmation, no cancellation fee applies.
20.2 If you cancel more than 7 calendar days, but the cancellation falls more than 14 calendar days after your booking confirmation, a cancellation fee of 35% of your total booking value is payable.
20.3 If you cancel less than 7 calendar days, but more than 48 hours, before your booking start time, a cancellation fee of 35% of your total booking value is payable.
20.4 If you cancel within 48 hours of your booking start time, a cancellation fee of 100% of your total booking value is payable.

20.5 If you choose to end a confirmed rental early, a cancellation fee of 100% of the remaining, unused balance of that booking is payable. We will not offer a refund or credit for a voluntarily shortened booking, save at our Manager’s sole discretion in exceptional circumstances.
20.6 Where your booking is declined due to our insurers’ requirements (see clause 11.1), we will refund the full amount paid, less any processing fees actually incurred, rather than applying the fees at clauses 20.1–20.5.
20.7 These cancellation charges represent our reasonable, genuine pre-estimate of the losses we are likely to incur when a booking is cancelled (including lost hire revenue, fleet allocation and administrative cost), and are not intended to, and shall not, operate as a penalty.

21. Vehicle Use, Prohibited Use and Geographic Restrictions

21.1 The vehicle must only be driven by drivers named on the rental agreement, must not be used to carry fare-paying passengers, must not be used for racing, rallying, off-road driving, or any illegal purpose, and must not be sub-let, sold, mortgaged or used to tow another vehicle or trailer.
21.2 Smoking is not permitted in any vehicle. A valeting charge of £200 applies if a vehicle is returned smelling of smoke or with smoking residue.
21.3 Unless we agree otherwise in writing in advance, vehicles must not be taken outside of the UK mainland.

22. Fuel

22.1 Vehicles are supplied with a full tank of fuel and should be returned full. If a vehicle is returned without a full tank, we will refuel it and charge you for the fuel used plus a reasonable refuelling administration fee.
22.2 You are responsible for using the correct fuel type. If the wrong fuel is used, you are liable for all resulting costs, including recovery, drainage and repair.

23. Fines, Tolls and Penalty Charges

23.1 You are responsible for, and must reimburse us for, all parking and traffic fines, congestion charges, toll charges, and any clamping, towing or storage costs, arising from use of the vehicle during your hire, together with a reasonable administration fee per incident.

24. Accidents and Breakdowns

24.1 Any accident, breakdown, fire, theft or loss involving the vehicle must be reported to us as soon as reasonably possible, and in any event within 24 hours, together with a completed accident report form where relevant. Failure to report promptly may invalidate insurance cover and make you liable for the full cost of any resulting loss or damage.

25. Our Liability

25.1 Nothing in these Hire Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under English law.
25.2 Subject to clause 25.1, our total liability to you in connection with a booking is limited to the total amount you paid for that booking.
25.3 We are not liable for any indirect or consequential loss, including loss of business, loss of enjoyment, or the cost of alternative transport, except where required by law.

26. Force Majeure

26.1 We will not be liable for any failure or delay in performing our obligations where that failure or delay results from circumstances beyond our reasonable control, including severe weather, strikes, fire, flood, pandemic, or governmental action.

27. Complaints

27.1 If you are unhappy with any aspect of your hire, please contact our Aftercare Team at info@seasoncars.com or 0207 046 0048 in the first instance. We aim to acknowledge complaints within 2 working days and resolve them as quickly as possible.

28. General

28.1 These Hire Terms, together with your signed rental agreement, constitute the entire agreement between you and Season Cars for that hire.
28.2 If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
28.3 These Hire Terms are governed by, and construed in accordance with, the laws of England and Wales, and any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
28.4 We may update these Hire Terms from time to time; the version in force at the date your booking is confirmed applies to that booking.
